    TRYING TO FORCE HOMEOWNERS TO SIGN WAIVER or REMOVE LANDSCAPING IS AGAINST THE LAW AND IS NOT IN THE HOMEOWNERS BYLAWS!

    Good Morning,
    I have had numerous conversations with multiple members of your staff from the maintenance person to the receptionist, and including Jody. I have also left multiple messages with Jody and the receptionist asking you to phone me. Here is my issue:
    1. I own the land my home is on from the edge of the curb to the fence north to south and east to west.
    2. I also own the landscaping on that property
    3. It is the homeowners associations responsibility to maintain and only maintain the landscaping in my front yard.
    4. The homeowners association does not have the right or authority to remove any of my landscaping, period.
    5. The homeowners association does not have the right to deface my property (spray paint on my trees), which includes my landscaping.
    6. The homeowners association does not have the authority to try and force me to sign a waiver to keep what is mine in the first place
    7. Nowhere in the HOA bylaws does it state you have the right to do any of the above mentioned items.
    8. I have contacted Jody via e-mail as well as voice to tell her that no one should remove any of my landscaping and I am not required by law to sign a waiver to keep what is mine in the first place.
    I expect a telephone call this morning from you, Carol. My numbers are listed below I will be unavailable from 9:30 – 11:00, so call anytime before or after.

    I'm not sure what there is to talk about. “Your points are correct” and the Board of Tramway has asked that those who do not want their trees trimmed would sign a waiver that they (the homeowner) will maintain their trees and shrubs. Would you like a copy of that Waiver?

    You missed my point, I am not required by law any federal, state or HOA bylaws to sign anything – it is my land, my landscaping. The bylaws clearly state what you are responsible for and required to maintain. Nowhere does it say any homeowner shall be required to sign waivers to keep what is theirs, or require them to begin to maintain what you say you are suppose to maintain according to the HOA agreement. If in fact I am required to begin maintaining what you are required to maintain according to HOA agreement then I no longer should be required to pay your associations fees.

    My attorney has reviewed the bylaws, you and the HOA are clearly in the wrong. I am prepared to take this to court if necessary – this is a democracy! I will not let anyone violate my rights!

    FYI – Carol has not returned my call to do this day (9/25/09) I did call her and request in writing that my tree would not be removed – she refused stating she could not put it in writing but has made note in my file. I did send further e-mail requesting this in writing as well stating if I did not have it writing prior to 10/1/09 I would stop paying HOA dues. I copied the president of the HOA as well as left voice mail still no return call or acknowledgement. Obviously the only best interest they have in mind is their own!
